Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Jesto websites, products, and services (collectively, the "Services") provided by Jesto ("Jesto", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Your account

To use most parts of the Services you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Acceptable use

You agree not to misuse the Services. In particular, you must not:

• Violate any applicable law or regulation, or the rights of any third party.
• Attempt to gain unauthorised access to the Services, related systems, or other accounts.
• Upload or transmit malicious code, spam, or content that is unlawful or infringing.
• Reverse engineer, decompile, or attempt to extract source code from the Services, except as permitted by law.
• Use the Services to build a competing product.

3. Subscriptions and payment

Paid plans are billed in advance on a recurring basis (monthly or annually) until cancelled. Fees are non-refundable except where required by law. We may change pricing on renewal with at least 30 days' notice.

4. Customer data

You retain all rights to the data you submit to the Services ("Customer Data"). You grant Jesto a limited licence to host, process, and display Customer Data solely to provide the Services. We treat Customer Data in accordance with our Privacy Policy.

5. Service availability

We aim to keep the Services available at all times but do not guarantee uninterrupted access. We may perform maintenance, suspend access for security reasons, or modify or discontinue features with reasonable notice.

6. Intellectual property

The Services, including all software, designs, trademarks, and content (other than Customer Data), are the property of Jesto or its licensors and are protected by intellectual property laws. No rights are granted to you other than those expressly set out in these Terms.

7. Confidentiality

Each party agrees to protect the other party's confidential information using at least the same degree of care it uses for its own confidential information, and not less than a reasonable standard of care.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Jesto's aggregate liability arising out of or related to these Terms or the Services shall not exceed the amounts paid by you to Jesto in the twelve months preceding the event giving rise to the claim. Jesto shall not be liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a way that risks harm to Jesto, other customers, or third parties. Upon termination, provisions that by their nature should survive will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Jesto is established, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively in the courts of that jurisdiction.
